Emery Celli Brinckerhoff & Abady LLP

Children's Rights/Education

The Firm has a particular commitment to protecting the rights of children, whether to a free appropriate public education, to a safe and nurturing foster or adoptive home, or to be free from unlawful misconduct by police and school officials.

  • In D.D. v. New York City Department of Education, the Firm is serving as class counsel to hundreds of disabled preschool children who are languishing on a waiting list for special education schooling and critical related services to which they are entitled by federal law.

  • In S.C. v. City of New York, the Firm represented a 16-year-old girl who had been subjected by school officials to an unlawful strip search while she was handcuffed in a school bathroom. The firm secured a settlement of $245,000 – one of the largest in New York City for a single strip search.

  • In a high-profile case in New Jersey, the Firm is representing siblings who were systematically starved by their foster and adoptive parents, even as state officials visited the home on numerous occasions and did nothing to prevent this tragedy.

  • In J.P. et al. v. New York City Department of Education, the Firm is representing four fourth-grade public school students who were strip searched by a school employee.
