Judicial Misconduct
The Firm has represented a number of state judges before the New York Commission on Judicial Conduct, the state agency responsible for investigating complaints of misconduct against judges of the New York State Unified Court System. Owing to the confidential nature of those proceedings, we are unable to list most of the judges we have represented. In one public case, the Firm represented Nassau Supreme Court Justice Ira Raab in his appeal to the New York Court of Appeals. Judge Raab had been censured by the Commission for engaging in forbidden political activity – campaigning on behalf of other candidates for office – and the Firm argued to the Court of Appeals that the rules prohibiting state court judges from engaging in political activity violate the First Amendment. Richard Emery was recently appointed to serve on the Commission on Judicial Conduct. As a result, the Firm does not currently handle judicial discipline matters. |
